1. The contest begins March 1, 2008 and ends August 31, 2008.
2. Contest is open to residents of the United States of America and Canada, 19 years of age or over.
3. Enter by logging on to www.khsbicycles.com and complete all Entry information requested.
4. Entries may be mailed, faxed, or emailed to KHS Bicycles for entry into contest.
5. Odds of winning depend on the number of eligible entries received.
6. NO PURCHASE NECESSARY. Limit one electronic entry per person, per e-mail address and per telephone number. Void where prohibited or restricted. Subject to all applicable laws.
PRIZES, RULES & REGULATIONS:
There is one Grand Prize trip to be awarded. Grand Prize consists of round-trip coach air transfer between LAX and Vancouver International Airport Round trip local ground transportation to and from Vancouver airport and Whistler, three (3) nights’ standard accommodation (double occupancy) in Whistler Village (property to be selected by Tourism Whistler); two day passes to Whistler Mountain Bike Park, and two (2) KHS bicycles of winners choice (subject to availability at time of contest award and limited to bicycles identified in Whistler Sweepstake advertisements). All other expenses not specified herein (including, but not limited to, transportation to and from the international airport closest to the winner's place of residence, pre- and post –travel arrangements, meals, airport taxes, telephone, fax or cable charges, personal services, expenses or hotel incidentals such as laundry, valet, room service, spa treatments, gratuities, optional tours, insurance, medical travel documents and other incidental costs, any applicable taxes and any other costs not specifically included in the prize package) are the responsibility of the winner and his/her guest. The winner and his/her guest must travel together. Winner and his/her guest are responsible for all required medical and travel related necessities (including inoculations) and documentation. Minors must be accompanied at all times by a parent or legal guardian. Trip must be completed within one year of winning, subject to blackout dates as given by any and all sponsors/co-sponsors of the Whistler Sweepstakes. Prize must be accepted as awarded and may not be substituted or converted to cash unless at the sponsor’s sole discretion. The Sponsor reserves the right to select airline and accommodation at its sole discretion. The Sponsors, at their sole discretion, have the right to offer monetary compensation in lieu of prizes listed above.
Prize is not transferable. No substitution or cash equivalent of the prize is permitted on the part of contest winners. Any portion of the prize not accepted by a winner will be forfeited. Tourism Whistler reserves the right to substitute prize in whole or in part in the event that any component of the prizes are unavailable, with a prize component thereof of equal or greater retail value. KHS Bicycles reserves the right to substitute bicycle prizes if needed because of availability, etc.
KHS Bicycles will retain the rights to promote the winner and guest’s name, likeness, or photograph in promotional materials relating to the contest. Approximate Retail Value of entire prize package is $5,000.00 US. (The actual retail value may vary depending on winner's point of origin, prizes selected, etc.).
HOW YOU COULD WIN:
1. A random drawing will be made at KHS Bicycles corporate offices on or about September 1, 2008 from among all eligible entries received by 23:59 PST on August 31, 2008.
2. Winning Entrants will be contacted within five (5) business days by telephone at the telephone number indicated on the Entry, and/or by e-mail at the e-mail address provided. If a selected Entrant cannot be reached within five (5) business days at the telephone number provided on the Entry form and/or at the e-mail address provided, prize may be forfeited and another Entry will be randomly selected from the remaining eligible Entries. Each Entrant will be sent and required to complete a required publicity release form, and if necessary, a Parental Consent form, which must be completed, signed and returned to the independent judging organization before the prize can be awarded.
3. If a selected Entrant is unable to accept the prize as awarded, prize will be forfeited and another Entry will be randomly selected from the remaining eligible Entries.
GENERAL RULES:
1. This contest is offered by KHS Bicycles, which may, at its sole discretion, use an independent administrator or agents to assist in any or all of the execution of this contest.
2. This contest is open to all residents of the United States of America and Canada, 19 years of age or over, excluding employees (and their immediate families and persons with whom they are domiciled) of the Sponsor, the Administrator, and any of their respective co-sponsors, direct parent companies, subsidiaries, affiliates, franchisees, independent judging organizations, promotional agencies, any and all contest administrators, broadcast partners and their respective advertising agencies.
3. Except as provided for in paragraph 7, by entering this contest, each entrant consents to the collection, use and distribution of his/her personal information (information that identifies an entrant as an individual, such as home telephone number, age and home address) by the Sponsor and/or the Administrator or their agents for the purposes of implementing, administering and fulfilling this contest. The Sponsor, the Administrator and agents will not sell or transmit this information to third parties, except for the purposes of administering the contest.
4. Entries submitted through fraudulent means or in any way tampered with, incorrect, unclear, forged, mutilated, illegible, indecipherable or mechanically reproduced may, at the sole discretion of the Sponsor, will be disqualified.
5. All Entries become the property of the Sponsor and shall not be returned. The Sponsor and the Administrator or their agents are not responsible for Entries lost, late, misdirected, illegible or delayed for any reason. No liability or responsibility is assumed by the Sponsor, or the Administrator or their agents for any technical problems in connection with the transmission or receipt of any e-mail or Online Entry including malfunction of any telephone or network lines, faulty electronic data transmissions, traffic congestion, in the Internet or website, hardware or software error, equipment failure or malfunction, or other on-line communications problems. No liability
or responsibility is assumed by the Sponsor, the Administrator or their agents resulting from user's attempt to participate in the promotion or download any information in connection with participating in the promotion. The Sponsor and/or Administrator reserves the right, in its discretion, to cancel or suspend (subject to KHS approval) this contest should a virus, bug or other cause beyond the reasonable control of the Sponsor to corrupt the security or proper administration of the contest.
6. The Sponsor and Administrator reserves the right to prohibit an Entrant from participating in the contest or winning the prize, if, in the sole discretion of the Sponsor or Administrator, it determines that the Entrant is attempting to undermine the legitimate operation of the contest by cheating, hacking, deception, or other unfair playing practices (including the use of automatic quick entry programs) or intending to annoy, abuse or threaten or harass any other Entrants or the Sponsor's representatives. The Sponsor reserves the right to disqualify any Entrant failing to comply with these Rules. Any attempt to deliberately damage any website or to undermine the legitimate operation of this promotion may be a violation of criminal and/or civil laws, and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law.
7. By submitting an Entry on-line, all Entrants must acknowledge and agree that the personal information that they have provided will be maintained on the Sponsor's server, the Administrator's servers and/or the server of those responsible for maintaining the KHS Bicycles website and/or administering the drawing.
8. The Sponsor, and their agents, including, without limitation, the Administrator, are not responsible for printing, distribution, technical or production errors, including computer hardware, software, systems or transmissions failures, and may terminate the contest if such errors are discovered, without liability and without notice, at their sole discretion. The Sponsor and Administrator or their agents reserves the right to modify or cancel the promotion in whole or in part.
9. An Entrant will not be declared a winner unless duly authorized representatives of the Sponsor and Administrator or their agents have reviewed and approved the Entry and the Entrant has signed and returned a Publicity Release Form of these rules (and if necessary, a Parental Consent form). By entering this contest, each Entrant agrees to comply fully with the Rules, and, for each winning Entrant, to the use of his/her name, image, photograph, voice, sobriquet, place of residence and/or statement regarding the Prize by the Sponsor and the Administrator for advertising, promotion or publicity purposes, or for general news, entertainment and information purposes, without compensation.
10. If a minor wins a prize, it will be awarded to his/her parents or legal guardian(s). Minor must be accompanied at all times by a parent or legal guardian.
11. No substitutions, transfers or cash value of prizes will be allowed except for the Sponsor's right to substitute prizes of equivalent value in the event of circumstances beyond the Sponsor's control.
12. In the event of any dispute regarding the identity of the party submitting an electronic Entry, the Entry will be deemed to have been submitted by the holder of the e-mail account.
13. This contest is subject to all Federal, State, and Municipal laws. Void where prohibited. All decisions made by the independent judging organization are final.
